WATER ADJUDICATION SEMINARS: A link from this Learning main menu choice discusses the North Idaho Adjudication Seminars, twenty-three of which Art Macomber completed in the North Idaho area for local residents owning or considering owning water rights. Many client feel Mr. Macomber's knowledge of Idaho water issues is enhanced by his continuing attention to Idaho water law, and the interaction between Idaho water use and Washington State claims to and on Idaho water, both regarding water quantity and quality.
NORTH IDAHO COLLEGE: As an adjunct professor at North Idaho College since 2007, Mr. Macomber teaches Contracts law (see PLEG-125 at link) to paralegal studies students. This course requires Mr. Macomber to stay abreast of contracts-related issues, including the common law applying to all types of contracts, and specialized areas of commercial Uniform Commercial Code (UCC) Article 2 Sales of Goods and Article 9 Secured Transactions. The UCC Article 2 covers contract provisions for the sale of goods in the entire supply chain from natural materials suppliers, manufacturers, wholesalers, and retailers. The Secured Transactions provisions of UCC Article 9 covers personal property security for loans, similar to how Deeds of Trust secure loan promises by encumbering real property.
GONZAGA UNIVERSITY SCHOOL OF LAW: In the Spring of 2012, Mr. Macomber will teach a Transactional Skills and Professionalism Lab to future lawyers. Transactional contracts frequently involve multiple documents, difficult drafting and coordination issues, and overlapping time frames that require close attention to detail and client-related production capabilities. Meeting a client's goals on time requires detailed knowledge and understanding of those goals, so that the substance of the contract and timing of conditions, fulfillment of promises, and negotiations meets the market requirements of business. Students wrestle with issues of ethics and professional responsibility. They also learn the distinctions between representations, warranties, covenants, conditions, and the other types of contract terms. As a lab course, students practice how to spot and avoid ambiguity when drafting or reviewing contract provisions, how to handle communications issues with difficult clients, and how to be a true counselor.
